What Happens After an Immigration Petition Is Approved?

 Getting your immigration petition (Form I-130 or I-140) approved is a major milestone, but it’s not the final step. Many people are surprised to learn there’s still a long road ahead before getting a green card or visa.

Step 1: Petition Approval

  • USCIS sends an I-797 Notice of Approval

  • It means your family or employer relationship has been verified

Step 2: Visa Availability

  • Immediate relatives of U.S. citizens can proceed immediately

  • Others (e.g., siblings, married children) must wait for a visa number

  • Check the Visa Bulletin monthly for priority date updates

Step 3: Consular Processing or Adjustment of Status

  • If abroad: Go through National Visa Center (NVC) and U.S. embassy interview

  • If in the U.S. legally: May file Form I-485 for Adjustment of Status

Step 4: Medical Exam and Interview

  • Medical exams must be performed by USCIS-authorized doctors

Final Step: Green Card or Visa Issuance

  • After approval, green card arrives within weeks
